Mediation is a form of alternative dispute resolution which can be particularly effective in certain divorce cases. In this process, the separating parties meet with one attorney who guides them through their issues. The process is client driven, and the mediator can provide both facilitative and evaluative services, as needed. Mediation allows clients to retain control of their outcomes. The mediator works with them to draft a settlement agreement which both parties have contributed to, and which both parties feel is fair and equitable. Mediators do not provide individual legal advice, and clients are encouraged to obtain independent legal counsel.
